On squaring, we get $ 9{{( \frac{d^{2}y}{dx^{2}} )}^{2}}={{{ 1+{{( \frac{dy}{dx} )}^{2}} }}^{3}} $
Obviously the highest derivative $ \frac{d^{2}y}{dx^{2}} $ contains a degree 2.
